When an individual is convicted of a second (or subsequent) offense in the last seven to ten years (the law changed 1/1/2002 from seven to ten years and will be phased in gradually), he or she will receive a minimum 10-day sentence from the court.
The first three days will be served at a Department of Corrections facility (county jail). This portion generally begins on Tuesday. On Friday participants are transported from the jail to the Multiple Offender Intervention Detention Center Program in Laconia for the next seven days. Participants are released the following Friday morning and must arrange for their own transportation home (unless additional jail time must be served). If continuing care recommendations are required, these must be completed before license restoration.
The Multiple Offender Program consists of the following:
- An intensive 7 day/6 night residential program. One evening is set aside specifically for family education and discussion;
- Alcohol and other drug education, group interactions and self-assessment; and
- An evaluation by a licensed or certified alcohol and drug counselor.
The fee is currently $1550, and is subject to subsequent increases without notice. Payment in full is due upon entry to the program, unless a participant arranges a payment plan with the Office of Reimbursements upon entrance.
Equivalent Programs If an individual convicted of an aggravated DWI offense or a second offense DWI is not able to schedule attendance at the multiple offender program within 21 days of conviction, they may choose an equivalent program approved by the Commissioner of DHHS.
