NH Administrative Rules require a food service license for the operation of any food service establishment or retail food store within NH. A Bed and Breakfast is defined as a transient lodging facility, that is the personal residence of its owner, is occupied by the owner at the time of rental to a patron, and in which the only meal served is breakfast to in-house guests. Facilities offering other meals or serving breakfast to non-guests are required to be licensed as a Commercial Kitchen.
For a license to operate a bed and breakfast facility, the following requirements must be met:
- Complete and Submit an Application for Annual Food Service License to the Food Protection Program;
- If the water is from a private well, submit water test results completed within the last 90 days. The tests shall include bacteria, nitrate and nitrites;
- A 2 bay sink or a one bay sink with a domestic dishwasher is acceptable for washing dishes, provided both dishes and utensils are manually sanitized with an approved sanitizer; and
- An air gapped drain, but not on sinks used for food preparation.
Commercial equipment is not required.
