Petitions for Declaratory Rulings

 

A petition for a declaratory ruling is a request from a party to the Health Services Planning and Review Board asking that the Board make a ruling "as to the specific applicability of any statutory provision or of any rule or order of the agency," as per RSA 541-A:1, V. Declaratory Ruling.

 

Any person may petition the Board for such ruling.  Petitions are filed with the Board via the staff at the Office of Health Services Planning and Review pursuant to He-Hea 218.  Staff will forward the request to the Board, who will then make a determination to grant or deny the petition during one of its publicly held meetings.  If in its determination the Board finds that such ruling is generally applicable to the regulated community, then it will initiate rulemaking to effectuate this decision.
