Welcome to the Legal Services Unit
 
The Legal Services Unit supports DHHS in three important areas: Legal Practice Services, Administrative Rulemaking, and Special Investigations.

 

Legal Practice Services is comprised of attorneys, para-professionals and support staff across DHHS who deliver a wide range of legal services to all DHHS program areas.  In addition to providing general counsel services, DHHS attorneys appear in various courts and administrative hearings in support of the Division for Children, Youth and Families, the Division of Child Support Services, New Hampshire Hospital and other areas of DHHS.

 

The centralized Administrative Rulemaking Unit has responsibility for coordination of all DHHS rule promulgation via the Administrative Procedures Act, including conducting public hearings and testifying before the Joint Legislative Committee on Administrative Rules.  This unit is also responsible for reviewing, editing and recommending all DHHS administrative rules for approval by the Commissioner.  The Administrative Rulemaking unit is the central repository for current rules and historical rule information. 

 

The Special Investigations Unit is responsible for the investigation of allegations of fraud in the public assistance programs administered by DHHS.  As part of this responsibility, the Special Investigations Unit prosecutes fraud cases in district courts throughout NH and prepares fraud cases for prosecution by County Attorneys in NH Superior Courts.  The unit also establishes claims for recovery of overpaid benefits and pursue recovery of these funds.
