Health Services Planning and Review

The Office of Health Services Planning and Review administratively supports the work of the Health Services Planning and Review Board, which is responsible for managing the Certificate of Need (CON) program.

A Certificate of Need (CON) is required to:

  • construct or modify health care facilities,
  • acquire new medical equipment, or
  • offer new inpatient care beds and services, subject to statutory thresholds.

Effective March 20, 2014, statutory thresholds will be:

  • $3,051,643 for any acute care facility project
  • $2,034,428 for any other licensed health care facility project (nursing home, ambulatory surgical center, rehabilitation hospital, psychiatric hospital, specialty hospital, outpatient clinics)
  • $400,000 for equipment remains unchanged

These figures will be updated when the new inflation factor is received later in February.

The Health Services Planning and Review Board is administratively attached to DHHS and its members are appointed by the Governor and Council. Appointments are staggered and no member is appointed for more than 2 terms. The DHHS Commissioner (or designee) is the only permanent member of the Board. Employee staff are assigned to perform administrative functions for the Board.

The Board meets approximately once per month and all meetings are open to the public.

The funds necessary to administer the CON program are 100% fee generated, with annual administrative fees assessed to each acute care hospital, specialty hospital and nursing home licensed in New Hampshire.

The following healthcare services, facilities, and diagnostic/therapeutic equipment items are regulated by the CON program and require Certificate of Need review and approval by the Health Services Planning and Review Board:

  • Acute Care (General) Hospital Beds and Services
  • Ambulatory Surgery Centers
  • Cardiac Catheterization and Cardiac Surgery Services
  • Extracorporeal Shock Wave Lithotripsy (ESWL) Services
  • Inpatient Physical Rehabilitation Beds and Services
  • Inpatient Adult Psychiatric Beds and Services
  • Inpatient Substance Abuse Beds and Services
  • Long Term Care (Nursing Home) Beds and Services
  • Megavoltage Radiation Therapy Equipment and Services
  • Magnetic Resonance Imaging (MRI) Equipment and Services
  • Positron Emission Tomography (PET) Equipment and Services
  • Transfer of Ownership of Non-Medicare/Medicaid Certified Facilities

In addition, a CON is required for any healthcare facility seeking to provide a new service that is regulated by the CON program.

Certificate of Need is not required for the following facilities/services:

  • Assisted Living
  • Home Health
  • Hospice
  • Kidney Dialysis
  • Medical Office Buildings
  • Outpatient Services
  • Parking Garages
  • Residential Care
  • Residential Treatment and Rehabilitation
  • Sheltered Care
  • Supportive Residential Care
