105.07 Refusal to Cooperate (FSM)

SR 97-27 Dated 08/97

Previous Policy

_____________________________________________________________

If the individual refuses to cooperate with the District Office in completing an eligibility requirement:

Deny or terminate benefits using adverse action procedures, or shorten the certification period and notify the individual of the new certification period.

To refuse, the Food Stamp household must be able to cooperate, but clearly demonstrate that it will not take the required action. If it is questionable whether the household failed rather than refused to cooperate, do not deny the case for refusal to cooperate.

Once denied or terminated for refusal to cooperate, individuals may reapply for assistance. Determine eligibility only after they cooperate.
