227.01 Individuals Not Considered Strikers (FSM)

An individual is not considered a striker if the individual is:

• exempt from work registration for any reason other than employment (such as care of a child) the day before the strike;

• not participating in the strike, but cannot work because of the strike (such as flight attendants who cannot work because of an airline pilot strike or truck drivers who cannot do their jobs because the strike has left them with nothing to deliver);

• not part of the bargaining unit and does not want to cross the picket line because of fear of personal injury or death; or

• locked out of the job by the employer, including individuals who were considered strikers before the lockout.
