307.01 Eligibility Within Institutions (FSM)

Residents of institutions are not eligible for SNAP benefits.

Individuals are residents of an institution when the institution provides them with more than half of their meals (50% of three meals daily) as part of normal monthly services, and the institution is not authorized to accept SNAP benefits.

Exceptions:

Individuals listed below may receive SNAP, if otherwise eligible:

• Residents of federally subsidized housing for the elderly;

• Narcotic addicts or alcoholics who reside in a facility or treatment center for the purpose of regular participation in a drug or alcohol treatment and rehabilitation program. This includes the children but not the spouses who are also living at the treatment center or facility;

• Homeless households residing in public or private nonprofit shelters;

• Residents of shelters for battered women and children; and

• Blind or disabled individuals residing in a public or private nonprofit group living arrangement serving 16 or fewer residents and certified under Section 1616(e) of the Social Security Act.
