319.05 Certain Convicted Felons  (FSM)

An individual is ineligible for SNAP if, any time after February 7, 2014, they have been convicted as an adult of any of the following crimes, and are not in compliance with the terms of their sentence:

·         Aggravated sexual abuse under section 2241 of title 18, United States Code;

·         Murder under section 1111 of title 18, United States Code;

·         An offense under chapter 110 of title 18, United States Code;

·         A Federal or State offense involving sexual assault, as defined in section 40002(a) of the Violence Against Women Act of 1994 (42 USC 13925(a); or

·         An offense under State law determined by the Attorney General to be substantially similar to the offenses in the first 3 bullets above.

Consider the income and resources of these disqualified individuals as 100% available to remaining household members. See Section 611.05, Income of Disqualified and Excluded Individuals, for more information.
