When the member is disqualified for intentional program violation or failure to comply with work requirements, including voluntary quit, or excluded from the household for any of the reasons listed in Section 611.05 , Income of Disqualified and Excluded Individuals, the income of the disqualified or excluded member is considered to be available to the remaining eligible assistance group members.

Treatment: Unearned Income.

• If a member was disqualified for an intentional program violation or failure to comply with work requirements, including voluntary quit, add the disqualified members earned income, after first subtracting the 20% earned income disregard and all other disregards and deductions for which they qualify, to their unearned income. The resultant income is considered unearned income and available in its entirety to the remaining household members.

• If a member was excluded for any of the reasons listed in Section 611.05, consider only a prorated share of their income as available to the household.

Example

A family of four applied for food stamps. The father earns $100 per week. He refused to give his social security number, insisting it was an invasion of privacy. Consequently, he is excluded from the case. His income is prorated: $25 is allotted to each of the four family members, including himself.

Exception: If an individual is an ineligible household member for any other reason (e.g., for being an ineligible student), do not consider any portion of that individuals income as available to the eligible household members and do not consider their needs when determining eligibility or benefit level.
