713.11 Recovering Overpayments/Overissuances Due to IPV: Collections (FSM)

OSI begins collection action on intentional program violation claims even if collection was previously begun while the claim was being handled as an inadvertent household error claim.

Exceptions:

• the household has already repaid the overissuance,

• there is documentation that the household cannot be located, or

• the collection has been referred for possible prosecution and the Supervisor, OSI, has concluded that collection will prejudice the case.

Repayment is due within 10 days of receipt of the demand letter. The remaining household members must repay the claim or their monthly coupon allotment is reduced.

When a court has found a household member guilty of misrepresentation or fraud, DHHS brings recovery of the overissuance before the court.

A personal contact is made with the household whenever possible.
