245.15 Verification Requirements SR 97-30, 08/97 (FSM-A)

Require third party documentation to establish that an ABAWD individual meets at least one exemption criteria, meets ABAWD work participation criteria or "cure" criteria. If the third party is an agency, business or organization, written documentation must be on letterhead.

Exception: A statement from the child's parent or individual exercising parental control is sufficient to document the child's intent to return to the home unless there is conflicting evidence.

Acceptable third party documentation includes signed and currently dated third party written statements or District Office verbal contact with the third party which confirms that the individual meets the appropriate ABAWD requirement or exemption criteria listed in one of the headings below. Self-employed individuals must document the actual number of hours worked and cannot substitute earnings equal to the hourly minimum wage.

Exemption Criteria:

. Hours of employment;

. Job attachment status;

. Responsibility of caring for child under age 18, and exercising parental control, if applicable;

. Age of ABAWD individual and/or dependents;

. Intent of child to return to return to the home if temporarily absent;

. Medical certification of pregnancy, inability to work, or disability of other adult household member;

. Work participation in an unemployment compensation program;

. Student status; or

. Regular participation in a supervised alcohol and drug treatment program.

 

ABAWD Work Participation Requirements/ABAWD "Cure" Requirements:

. Hours of employment;

. Participation in a state or local workfare program that is to the satisfaction of the town or city requiring the workfare, or

. Participation in and compliance with a work program other than job search or job search training.
