Notice to Vendors
Federal Uniform Guidance requires the Department of Health and Human Services (Department) to assess all subrecipients of federal funding for risk of potential contract noncompliance and to monitor identified risks (see 2 CFR 200.300 et seq.). To address these requirements, the Department is implementing a comprehensive monitoring program that will apply to all Federal, State general, or other funded contracts.

As part of the new process, all vendors responding to procurement requests will be required to complete a Management Questionnaire, which includes twenty-two (22) Yes/No questions, and return it with the proposal or application packet. The Department will assess the vendor for risk of potential noncompliance with Federal and/or State law and/or the terms and conditions of the contract.

If any programmatic or financial risks are identified, monitoring provisions will be included in any resulting contract allowing Department staff to monitor those risks throughout the life of the contract. In rare circumstances, the Department may preclude a vendor from selection if the level of programmatic or financial risk present is deemed to be unmanageable.
