Notice of Opportunity for Public Comment 1/11/2021-2/12/2021

Pursuant to 42 C.F.R. §441.301(c)(6)(iii) notice is hereby given that the New Hampshire Department of Health and Human Services, as the single state Medicaid agency, intends to submit a renewal of its Section 1915(c) Developmental Disabilities Waiver to the Centers for Medicare and Medicaid Services (CMS).

This renewal is primarily a continuation of the current Developmental Disabilities Waiver and reflects:

  • Compliance with recently updated federal regulations
  • Service limits for selected services
  • Updated Performance Measures
  • Covered Services

DHHS would like your comments about the changes it is proposing in the draft 1915 (c) Developmental Disabilities (DD) Waiver. After receiving the public’s ideas and comments about the proposed changes, DHHS will make final decisions about what changes to make to the DD Waiver renewal application and submit to CMS. The summary of comments will be posted for public viewing, along with the waiver application when it is submitted to CMS.

This notice contains links to material developed by the Department regarding its renewal of the 1915(c) Developmental Disabilities Waiver. DD Waiver renewal documents as well as dates, times, and links to opportunities for public input related to this renewal will be posted on the DHHS website.

Opportunity for Public Input
The public is invited to review and comment on this draft waiver renewal. The draft waiver will be available for review on January 11, 2021. Read the complete version of the current waiver document Adobe Acrobat Reader Symbol.

A hard copy of the draft waiver renewal document may also be picked up, with prior notice, at BDS from 8:00 AM – 4:30 PM Monday through Friday at: Department of Health and Human Services, Bureau of Developmental Services, 105 Pleasant Street, Main Building, Concord, NH 03301-3857.

Public comments may be submitted from January 11, 2021 until 12:00 noon on February 12, 2021. Comments may be submitted by email to DLTSSWaiverRenewal@dhhs.nh.gov or by regular mail to: Jessica Kennedy, NH Department of Health and Human Services, Bureau of Developmental Services, 105 Pleasant Street, Main Building, Concord, NH 03301-3857.

Stay Informed
There will be further opportunities to provide additional stakeholder feedback and public comment on the waiver prior to submission to CMS. BDS, working with the IOD, will also provide public notice of formal public comment sessions in the Fall of 2020.
