245.09 Regaining Eligibility After Closing for Failure to Meet ABAWD Work Requirements (FSM)

A non-exempt ABAWD who has received 3 full months of SNAP benefits while not meeting ABAWD work requirements and who has lost or will be losing eligibility for failure to meet these work requirements can regain eligibility if, during any 30 consecutive days, they have:

     worked at least 80 hours (for pay, for goods or services, or as a volunteer);

     participated in a work program for at least 80 hours;

     performed any combination of work and a work program for at least 80 hours; or

     become exempt from ABAWD work requirements.

The individual may also regain eligibility, from the date of application, if they verify they will meet one of the above requirements within 30 days of the application.

The ABAWD can continue to receive SNAP benefits as long as they continue to meet work requirements or an exemption.

There is no limit on how many times an individual may regain eligibility and maintain eligibility by meeting the work requirement.

An ABAWD who has regained eligibility and then stops meeting work requirements for a second time can receive an additional 3 months of SNAP. See Section 245.13, The Additional 3 Month Cure Period, for more information on this.
