419.07 Resource Increases During the First Year of Eligibility (MAM)

During the first year of eligibility, if the institutionalized spouse has an increase in resources and the community spouse had less than the protected resource amount in countable resources at the eligibility determination, complete the following:

1. Total the institutionalized individual’s current countable resources.

2. Add the community spouse’s own countable resources that were available at the time the eligibility determination was done.

3. Subtract the community spouse’s protected resource amount that was computed at the time the eligibility determination was done.

4. Compare the balance to the medical assistance resource limit, to determine if the institutionalized individual remains eligible.

Increases in the community spouse’s resources during the first year of eligibility do not affect the institutionalized individual’s resource eligibility.

Example

At the eligibility determination, the combined resources were $21,000 ($18,500 protected resource amount). Six months later the institutionalized individual inherits $6,000. Follow the steps listed above.

$7,000 institutionalized individual’s current resources ($6,000 inheritance + $1,000)

+13,500 community spouse’s own countable resources at eligibility determination

20,500

- 18,500 protected resource amount

$2,000 compare to the $2,500 resource limit. The individual is still resource-eligible.
