627.01 Allocation to Dependents (MAM)

Previous Policy

Allow an individual to allocate income to provide for the unmet needs of their dependent if the individual is one of the following:

. not institutionalized, or

. is institutionalized with no community spouse.

Consider a person a dependent if they are related to the individual in any of the following ways:

. parent, provided the individual requesting allocation is age 18 or older and the case head,

. child, provided the child is under age 18, or age 18 or older and unable to work due to a temporary or permanent physical or mental disability, or

. spouse, provided the individual requesting allocation is institutionalized, and the couple are not legally separated or divorced.

In addition the dependent must meet all of the following requirements:

. have insufficient income to meet their personal needs,

- The monthly needs of the dependent are based on and compared to the FANF payment standard. See Family Assistance Manual, Chapter 600, Standards and Budgets.

. is financially dependent on the individual wishing to allocate income, and

. is not eligible for any financial or medical assistance program administered by the Division of Family Assistance for any reason other than ineligibility due to income or resources.

Steps to Allocating Income to a Dependent

1. Determine the dependent's available income.

2. Determine the correct FANF payment standard based on the following:

- Use the payment standard for a group size equal to the number of dependents in the same household, or

- If there are 2 or more dependents that live in separate households, determine the dependent's needs separately. Use the payment standard for a group size equal to 1 for each dependent living in separate households.

3. Subtract the dependent's available income from the appropriate FANF payment standard.

4. If the available income is:

- less than the FANF payment standard, the difference is considered the dependent's unmet needs. Allocate income equal to the unmet needs.

- equal to or greater than needs, do not allocate income.
