On September 1, 2015, CMS approved the State's initial 1915(b) waiver request, to mandate enrollment in the managed care delivery system for enrollees who could previously elect to receive their state plan services through the fee-for-service delivery system, pursuant to 42 CFR 438.50(d)(1-3). New Hampshire seeks the authority, through this waiver renewal request, to continue to mandate those enrollees who could previously elect to receive their state plan services through fee-for-service delivery system, pursuant to at 42 CFR 438.50(d)(1-3), to enroll with an MCO to receive their state plan services.

The Department will accept public comments on the proposed waiver renewal until midnight December 27, 2017.

Section 1915(b) of the Social Security Act, provides states with the flexibility to modify their delivery systems by allowing CMS to waive statutory requirements for comparability, statewideness, and freedom of choice. On August 7, 2015 the Centers for Medicare & Medicaid Services (CMS) approved New Hampshire’s 1915(b)Adobe Acrobat Reader Symbol to allow the State to provide mandatory enrollment in a managed care delivery system for selected voluntary populations in our managed care program authorized under section 1932 of the Social Security Act (the Act). The waiver was approved for a 2 year period effective September 1, 2015 through August 31, 2017. Public comment can be submitted to 1915bwaiver@dhhs.nh.gov.

On June 19, 2017, the Department of Health and Human services submitted a temporary 90 day extension of our 1915(b) waiver to arrange for and submit an independent evaluation of the first waiver period of September 1, 2015 through August 31, 2017. On June 22, 2017 CMS granted the temporary 90 day extension Adobe Acrobat Reader Symbol. The temporary extension will expire on November 30, 2017. The renewal application and independent evaluation of the program is due by September 2, 2017.

On August 15, 2017, the Department submitted a second request for an additional 30-day temporary extension in order to complete the financial analysis and to honor a comment period prior to submission. This extension request was approved by CMS with an expiration date of December 31, 2017.

On October 3, 2017, the Department submitted a request for an additional 90-day temporary extension in order to align the waiver with the Federal Fiscal Year for ease of quarterly cost effectiveness reporting. On October 4, 2017, CMS granted the temporary 90 day extension Adobe Acrobat Reader Symbol with an expiration date of March 31, 2018.

As soon as the 1915(b) waiver renewal and independent assessment are complete the Department will post those documents on this page and will begin accepting public comments on the 1915(b) waiver renewal for a period of 30 days.
