SUMMARY
This SR releases a change in the order of the eligibility filter cascade sequence when determining eligibility for Food Stamp (FS) benefits.

Eligibility for Food Stamp (FS) benefits was previously determined in this order: 1. First Step: The household (HH) was reviewed for categorical eligibility for FS; if all HH members received Supplemental Security Income (SSI), Financial Assistance to Needy Families (FANF), Old Age Assistance (OAA), Aid to the Need Blind (ANB), or Aid to the Permanently and Totally Disabled (APTD) financial assistance benefits, the HH was considered categorically eligible for FS. No resource test was applied during this step; 2. Second Step: If the HH was not found to be categorically eligible for FS benefits, the HH’s eligibility for regular FS benefits was reviewed. During this step, gross and net income limits and a resource test was applied, and the HH needed to provide all required verifications; and 3. Third Step: If the HH failed eligibility for regular FS benefits due to excess income or resources, the HH’s eligibility for Expanded Categorical Eligibility was reviewed, per Food Stamp Manual (FSM) 231.01, Categorical Eligibility Criteria, and FSM 611.01, Computing Income Eligibility. Transfer of asset resource questions were asked but no resource test was applied. |
Eligibility for FS benefits is now determined in this order: 1. First Step (no change): The HH is reviewed for categorical eligibility for FS benefits. If all HH members receive SSI, FANF, OAA, ANB, or APTD financial assistance, the HH is considered categorically eligible for FS and no resource test is applied; 2. Second Step (changed): If the HH is not determined to be categorically eligible for FS benefits, the HH’s eligibility for Expanded Categorical Eligibility is reviewed. Transfer of asset resource questions must still be asked at this step, but, per current policy, no resource test is applied, and eligibility criteria described at FSM 231.01 must still be met; and 3. Third Step (changed): If the HH is not found to be eligible for Expanded Categorical Eligibility, the HH’s eligibility for regular FS benefits is determined. Gross and net income limits and a resource test apply. Note: FS eligibility criteria for Expanded Categorical Eligibility remains unchanged; it is merely the order in which eligibility is reviewed that has changed. |
POLICY
Determine eligibility for Food Stamp (FS) benefits as follows:
· First Step: Determine if the household (HH) is categorically eligible for FS benefits, e.g. all HH members receive SSI, FANF, OAA, ANB, or APTD financial assistance benefits.
· Second Step: If the HH is not categorically eligible for FS benefits, determine the HH’s eligibility for FS using the expanded categorical eligibility criteria at FSM 231.01. During this step of the eligibility determination process, transfer of asset questions are asked, per 7 CFR 273,2(j)(4)(iii)(A), but no resource test is applied, per current policy.
· Third Step: If the household is not eligible for FS benefits using the expanded categorical eligibility criteria, only then determine eligibility using the regular FS criteria of applying gross and net income and the resource test.
This policy obsoletes the Director’s Memo dated February 20, 2015, subject line, Including Additional Households for Expanded Categorical Eligibility.
NEW HEIGHTS SYSTEMS PROCEDURES AND IMPLEMENTATION
New HEIGHTS will be updated with the new eligibility filter cascade sequence for determining Food Stamp eligibility effective May 1, 2015, and will apply the new eligibility determination cascade sequence to any FS application beginning on or after that date.

IMPLEMENTATION
The policy released in this SR is effective May 1, 2015 and will apply to any new cases processed on or after that date.

No special client notification is planned.

No special training is planned.
DISPOSITION
This SR may be destroyed or deleted after its contents have been noted and the revised manual topics released by this SR have been posted to the On-line manuals.
DISTRIBUTION
This SR will be distributed according to the electronic distribution list for Division of Family Assistance policy releases. This SR, and revised On-Line Manuals, will be available for agency staff in the On-Line Manual Library, and for public access on the Internet at www.dhhs.nh.gov/DFA/publications.htm, effective April 27, 2015. Additionally, this SR, and printed pages with posting instructions, will be distributed under separate cover to all internal hard copy holders of the Food Stamp Manual.
