403 WHOSE RESOURCES COUNT? (MAM)

SR 14-04 Dated 01/14

Previous Policy

____________________________________________________________

There is no resource test for MAGI-related medical assistance; resources do not count in the MAGI eligibility determination process.

For the non-MAGI-related medical assistance groups, consider all resources owned by or available to all members of the assistance group. Assistance group composition differs based on the type of assistance requested. See Chapter 200, Program Criteria, to determine who is included in the assistance group.

Resources may be counted from people not in the assistance group, such as alien sponsors and excluded parents.

Exception: If an institutionalized individual has a community spouse, consider the resources of both the institutionalized individual and the spouse, even though they do not reside together at initial eligibility determination only. See PART 417, Resource Assessment. and PART 419, Protection of Resources.
