Notice of Amendment to the Home and Community Based Services, Section 1915(c), Developmental Disabilities (DD), Acquired Brain Disorder (ABD) and In Home Supports (IHS) Waivers

Notice of Opportunity for Public Comment 4/4/2023-5/15/2023

Pursuant to 42 C.F.R. §441.304(f) notice is hereby given that the New Hampshire Department of Health and Human Services, as the single state Medicaid agency, intends to submit an amendment of its Section 1915(c) Developmental Disabilities, Acquired Brain Disorder, and In Home Supports Waivers to the Centers for Medicare and Medicaid Services (CMS).

These amendments reflect:

• Updated language regarding compliance with federal regulations related to Conflict Free Case Management and Direct Billing requirements
• Updated language surrounding the ability to bill via the Organized Health Care Delivery System (OHCDS) for certain services
• Updated cost of care language

DHHS would like your comments about the changes it is proposing in the draft DD, ABD, and IHS Waiver amendments. After receiving the public’s ideas and comments about the proposed changes, DHHS will make final decisions about what changes to make to the DD, ABD, and IHS Waiver amendment applications and submit to CMS. The summary of comments will be posted for public viewing, along with the waiver applications when they are submitted to CMS.

Opportunity for Public Input
The public is invited to review and comment on these DD, ABD, and IHS draft waiver amendments. The draft amendments will be available for review on April 4, 2023 at Developmental Services' Home and Community Based Services webpage at https://www.dhhs.nh.gov/programs-services/disability-care/developmental-services/1915c-home-and-community-based-services

A hard copy of the draft waiver amendment documents may also be picked up, with prior notice, at BDS from 8:00 AM – 4:30 PM Monday through Friday at Department of Health and Human Services, Bureau of Developmental Services, 105 Pleasant Street, Main Building, Concord, NH 03301-3857.
